Terms of Service

Welcome to Pointify. These Terms of Service (“Terms”) govern your access to and use of the Pointify platform, including our website at pointifytravels.com, mobile applications, APIs, and all related services (collectively, the “Service”) operated by Pointify Travel Technologies, Inc. (“Pointify,” “we,” “us,” or “our”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the “Last updated” date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.

2. Service Description

Pointify is a travel search, comparison, and booking platform that provides the following capabilities:

• Aggregated flight search across 300+ airlines, including NDC fares and award availability
• Points and miles optimization across 25+ loyalty programs
• Transfer partner rate comparison and bonus tracking
• Fare prediction and price alerts
• Advanced routing features including hidden city ticketing and multi-carrier stitching
• AI-powered booking agent capabilities
• Hotel search and booking
• Trip planning and group travel coordination
• Loyalty account synchronization via direct login or Plaid integration
• Developer API and MCP server access

The Service acts as an intermediary. While we facilitate search and, in some cases, booking, we are not the airline, hotel, or other travel supplier. The actual travel services are provided by third-party carriers and suppliers subject to their own terms and conditions.

3. User Accounts

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security and confidentiality of your login credentials
• Promptly update your account information if it changes
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in abusive behavior.

Account Types

Pointify offers several account types: Client accounts for individual travelers, Agent accounts for travel professionals, and Admin accounts for platform administrators. Each account type carries different capabilities and responsibilities.

4. Payment Terms

Subscription Plans

The Service offers free and paid subscription tiers (Pro, Business, Enterprise). Paid subscriptions are billed through Stripe on a monthly or annual basis. By subscribing to a paid plan, you authorize Pointify to charge your payment method on a recurring basis until you cancel.

Booking Payments

When you book travel through the Service, payment is processed via Stripe. You authorize us to charge the total amount shown at checkout, including applicable taxes and fees. All prices are in US Dollars unless otherwise stated.

Price Freezes

Price freezes allow you to lock in a fare for a limited time (typically 48 hours) for a non-refundable fee. If you do not complete the booking within the freeze period, the freeze expires and the fee is not refunded. We do not guarantee that the fare will remain available after the freeze period, even if the freeze is active.

Refunds

Subscription refunds are handled on a case-by-case basis. Booking refunds are subject to the policies of the underlying airline or travel supplier. Price freeze fees are non-refundable. Contact support@pointifytravels.com for refund inquiries.

5. Booking Disclaimers

Agent-Assisted Bookings

Pointify may facilitate bookings through an AI-powered booking agent that navigates airline and supplier websites on your behalf. By using this feature, you understand and agree that:

• The agent acts as your authorized representative when interacting with travel suppliers
• All bookings are subject to the supplier's terms and conditions, which you agree to by completing a booking
• Agent bookings require your explicit confirmation and approval before any payment is processed
• We are not responsible for errors made by the agent, though we strive for accuracy and provide human review checkpoints
• Availability and pricing may change between search and booking completion

Hidden City Ticketing

The Service may display “hidden city” fare opportunities where deplaning at a layover city can result in significant savings. By using hidden city routing, you acknowledge and accept the following risks:

• Airlines generally prohibit hidden city ticketing in their contracts of carriage
• Your frequent flyer account may be penalized or closed by the airline
• You cannot check bags to your true destination when using hidden city routing
• Return flights on the same ticket may be canceled by the airline
• Itinerary changes by the airline could reroute you away from your intended layover city
• Pointify provides this information for educational purposes and does not guarantee that any particular hidden city itinerary will be honored

Self-Connect / Multi-Carrier Stitching

The Service may suggest itineraries that combine separate tickets on different airlines (“self-connect” or “multi-carrier stitching”). When booking self-connect itineraries, you understand that:

• Each flight segment is a separate contract with its respective airline
• If one segment is delayed or canceled, the other airline has no obligation to accommodate you
• You are responsible for rechecking baggage and clearing security/immigration between segments
• Adequate connection time between segments is your responsibility
• Travel insurance covering missed connections on separate tickets is strongly recommended
• Pointify is not liable for missed connections on self-connect itineraries

Fare Accuracy

Fares, points requirements, and availability displayed on the Service are sourced from third-party APIs and may change without notice. We make reasonable efforts to display accurate information but cannot guarantee that prices shown will be honored by the airline or supplier at the time of booking.

6. Loyalty Account Synchronization

The Service offers the ability to sync your loyalty program accounts to display balances, tier status, and activity. You may connect accounts via:

• Direct login credentials: Encrypted with AES-256 and stored securely. We access your loyalty accounts solely to retrieve balance and activity information.
• Plaid integration: For bank-linked loyalty programs. Plaid's own terms and privacy policy apply to data shared through their service.

By providing loyalty credentials, you authorize Pointify to access these accounts on your behalf. You may revoke this access at any time by removing the connection from your account settings. We do not store plaintext credentials and cannot access them after encryption.

7. Intellectual Property

The Service, including all software, algorithms, designs, text, graphics, logos, and data compilations, is the intellectual property of Pointify Travel Technologies, Inc. and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. You may not reverse engineer or attempt to extract the source code of our software, except where such restrictions are prohibited by applicable law.

API and Developer Access

If you access the Service through our API or MCP server, you are granted a limited, non-exclusive, revocable license to use the API in accordance with our API documentation and rate limits. You may not resell API access or use it to build a competing service without prior written agreement.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Scrape, crawl, or use automated means to access the Service beyond our provided API
• Attempt to gain unauthorized access to other users' accounts or our systems
• Interfere with or disrupt the Service or servers
• Circumvent rate limits, subscription restrictions, or security measures
• Submit false or misleading information
• Use the Service to engage in fraud, including booking fraud or loyalty program abuse
• Share your account credentials with third parties

9. Limitation of Liability

To the maximum extent permitted by applicable law, Pointify Travel Technologies, Inc., its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your use or inability to use the Service
• Any errors, inaccuracies, or omissions in fare, pricing, or availability information
• Unauthorized access to or alteration of your transmissions or data
• Actions or omissions of third-party travel suppliers
• Missed flights, connections, or other travel disruptions
• Loss or compromise of loyalty account credentials
• Any other matter relating to the Service

Our total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to Pointify in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any fare or availability information will be accurate or current.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pointify Travel Technologies, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) your use of hidden city ticketing, self-connect itineraries, or other advanced routing features.

12. Termination

You may terminate your account at any time by contacting support@pointifytravels.com or using the account deletion feature in your settings. We may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. You may request export of your data prior to deletion in accordance with our Privacy Policy and applicable data protection regulations.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within thirty (30) days, either party may pursue binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Delaware, United States.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action or class-wide arbitration.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware.

15. IATAN Accreditation

Pointify Travel Technologies, Inc. is an IATAN-accredited travel agency. As an accredited agency, we adhere to IATAN standards and regulations. Our accreditation enables direct booking capabilities with airlines and travel suppliers. IATAN accreditation does not constitute an endorsement of Pointify by IATAN or any airline.

16. Miscellaneous

Entire Agreement

These Terms, together with the Privacy Policy and any other agreements referenced herein, constitute the entire agreement between you and Pointify regarding the Service.

Severability

If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

Assignment

You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
